Terms of Service

1. Acceptance

By accessing or using Akyeba ("the Service"), you agree to be bound by these Terms of Service. If you are accepting on behalf of a school or organisation, you represent that you have authority to bind that entity.

2. The Service

Akyeba provides cloud-based school operations software including attendance tracking, academic records management, report card generation, fee management, and communication tools. The Service is provided "as is" and we continuously improve it.

3. Accounts and access

• You must provide accurate information when creating an account.
• You are responsible for maintaining the confidentiality of your credentials.
• You must notify us immediately of any unauthorised access.
• One school tenant per subscription. Multi-school requires separate tenants or an enterprise agreement.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorised access to other tenants' data.
• Reverse-engineer, decompile, or disassemble the Service.
• Upload malicious code or interfere with the Service's operation.
• Share login credentials across multiple individuals (each user needs their own account).

5. Data ownership

Your school retains ownership of all data entered into the platform. We process it on your behalf to provide the Service. See our Privacy Policy for details on data handling.

6. Subscription and payment

• Pricing is as published on our pricing page or as agreed in a custom contract.
• Subscriptions are billed termly or annually as selected.
• Non-payment after a 14-day grace period may result in service suspension.
• Refunds are handled on a case-by-case basis within 30 days of payment.

7. Service availability

We target 99.5% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our control (internet outages, AWS regional failures, force majeure).

8. Limitation of liability

To the maximum extent permitted by Ghanaian law, TheKloudWiz's total liability for any claim arising from the Service is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

• Either party may terminate with 30 days' written notice.
• We may suspend or terminate immediately for material breach of these Terms.
• Upon termination, you may request a data export within 30 days. After 12 months, data is permanently deleted.

10. Intellectual property

The Service, its design, code, and documentation are the intellectual property of TheKloudWiz. Your subscription grants a non-exclusive, non-transferable licence to use the Service for your school's operations.

11. Governing law

These Terms are governed by the laws of the Republic of Ghana. Disputes shall be resolved through arbitration in Accra under the Ghana Arbitration Centre rules, unless both parties agree to mediation first.

12. Changes

We may update these Terms with 30 days' notice. Continued use after the notice period constitutes acceptance. Material changes will be emailed to account holders.
